over a period of time. Of course this would not be necessary if an individual has lived in one jurisdiction most of

We
recommend that employers do not limit their background searches to a state-wide search only. The information contained
in the records of a state repository is dependent on police agencies and courts submitting their information to the repository.
This is often not the case. Many times, performing a state-wide search is not as thorough as checking the individual
county/state an applicant has lived in. Additionally, there are cases of inaccurate data, cases which have been thrown
out of court; however, the information has not been purged from a database. Thus a potential employee is denied employment
in inaccurate and false information, leaving your company subject to legal liability if this information is not verified to
be accurate prior to denying employment.

Do you use database searches or CD-ROMS to obtain public
record data?
Answer: Ninety-one percent (91%) of the county criminal record searches performed require
that an investigator or field agent go physically to the courthouse and complete an in-person search of the criminal court
record docket. All investigators or field agents used are experienced and seasoned public record abstractors. Many of
the searchers have trained paralegal backgrounds, are attorneys, or have worked in the Clerk of Courts Office. Currently 9%
of the court repositories have only real time - on line access to their criminal court records. This method provides actual
images of the true court record via the court's own automated system and the information retrieved is the exact same in both
image and timeliness as if a physical search had been performed manually in the courthouse. These courts generally do not
maintain printed court record information. This automated information is obtained by the same personnel that would normally
conduct the physical search. It is conducted either at the actual courthouse on a computer terminal or via a direct computer
interface which has been authorized by the clerk of the court. A service is NOT used. Criminal court record information
extracted from CD-ROMS, diskettes or any non-court databases is NOT used. This material has inherent risks, generally fails
to meet the requirements under the FCRA and does not provide our clients with thorough and up-to-date investigative results.
